Default Ebay question - 12-28-2009, 05:06 PM

Hey I just had a quick question regarding sales on ebay...basically a few days ago there was a pair of Sakura Birds up for bidding which I put a bid in for but unfortunatly didn't win. Today I got an email saying I have a second chance bid since the last guy didn't pay for them. However the seller had put a buy it now price of $0.99 (by accident I'm assuming), so obviously I purchased them straight away. Now I don't know if he realises it was a mistake, so I wanted to know if he has to send them now by law, or would he still be able to back out of the contract since he most likely made a mistake? If someone could let me know asap that would be great...hopefully he still has to send them over to me

if he wants to he can back out. All that would happen is that he would get some kind of ebay strike and 3 of those strikes means you are banned from ebay. But there is nothing you can do about it if the guy withdraws.

Technically there is no actual law which could force the seller to sell the goods if he has made a genuine mistake. Obviously errors are not your fault and should the seller decide not to sell the goods to you at that price then E Bay may place a strike against his account. Given you have paid for the goods he can simply refund you via Paypal so that wouldnt have any baring on the outcome.
What you need to consider is that in just the same way you expect sellers to be honest, its also only right that buyers are too. I mean you realise the seller has made a genuine mistake. Isn't it only right to come to an agreed fair price to resolve the issue rather than trying to persue what must have been an expensive item for the seller to buy initially who has to take a massive loss? Maybe the seller will offer the goods at a price below what you bid when you lost the auction originally, after all you must have been happy with that price to have initially placed a bid on it.
I believe if you persue the seller to give up the goods at just $0.99 I think you will end up with nothing at all. In all fairness the seller could agree but charge $300 for P & P to make up his losses, what will you do then?
I think its always best to do the right thing in my opinion, we all want bargains but we must never allow our morals to be overcome by our desire. Do the right thing buddy, and the rewards will be greater in the long run

Yeah thats true...I mean I don't mind paying the original price that I bidded for them, but just wanted to know just in case. Thanks guys

I AGREE WITH dunny and what he said, but thought i'll add my view aswell. if you have paid the seller, wait untill they replies, if they do not reply, then email them, once you have accepected the 2nd chance offer, then the seller has to ship the jeans to you regardless, because they have entered a binding contract with you, they can not change the shippings costs, it has to be the same shipping cost that were stated in the Original listing. In this case it does look like the seller has made a clear mistake, because you have stated that the 2nd chance price is less then what you have bidded, therefore it will be morality incorrect paying £0.99 for a pair of these jeans, i would advise you to email the seller, and ask him if the second chance offer of £0.99 was correct, if it wasn't, then ask what was the offer was ment to be and go from there, but if the offer was correct; MAN YOU DID ONE HELL OF A DEAL !!!

Heh, heh, yeah in theory if he has re listed the item and offered you a Buy it Now he can change the terms and conditions ( including the P & P ) but its likely that a 2nd chance bid usually refers to the original auction. My nephew got whacked by a seller in Canada who did a similar thing, the jeans were mega cheap so he clicked the buy it now. He didnt read the P & P was changed to $150!! LOL So my nephew was now in the position that he would recive Neg feedback if he didnt pay for jeans that were now very overpriced! Needless to say he didnt pay and nothing came of it cos the seller knew he was crooked doing what he did, but it certainly taught him a lesson!

really, thank you dunny, i wasnt aware of that, makes me wonder, i offer so many 2nd chance offers !! some people on ebay are really bad timewasters!! soo annoying, and you have to wait one week before you can give them a strike!! i purchased this jacket, cost me $290, from usa, but it was to big, i return it, got a full refund, but then the seller, instead of fileing a transaction cancelling form, send me an un-paid dispute, i couldnt do nothing, because of the new ebay policy, i emailed customer services stating i have paid for the jacket, and returned it to the seller, for a full refund, and that i was given a refund. and they wrote back and i quote " i will have to accpect the strike and then appeal" ( something like that ) I was hit with a stike!! but im a figher ! lol. i appealed to ebay customer support, as they told me do to. i gave the the orginal paypal transaction number, and the refund number as well, wrote 2000 words of my mind, and what i thought abot what happened!! and sorry to say, i havent seen the seller on ebay since !!!! and i got my strike overturned !!! .. lol,. i thought i'll share my story as well !!

N I GOT A 3 DAY BAN FROM SELLING ON EBAY !! it will be lifted 2night @ 12.05 !! FOR KEY SPAMMING !! I.E WRITING OTHER BRANDS IN MY LISTING TITTLE !! i would advise no one on this forum to do that !!!!! just giving the heads up !! lol

For every decent person there is on E Bay there will be a scammer, its these people that give E bay such a bad name sadly. The system is sound but so many people are put off E bay because of a basic lack of good old fashioned honesty, and its the same the world over. E bay certainly doesnt have the monopoly on this. Thats why its up to, not only Sellers, but Buyers as well to play the game fair because once you have had a bad experience you are unlikely to use the service again. E Bays policies can seem pretty harsh but they have had to tighten up in the past few years or face going out of business.

it's funny the guy with the Multi-color dragons that I had such a hard time getting my refund back actually contacted me to do a second chance offer to me with them. I told him I was just going to get them from Machi. I've never had a problem with him. Now I just have to recover from the holidays and I might get all 3 dragons if they are still available.
