Ok, HERE IT GOES..

i made a offer on a jacket on ebay.com of about £275, the seller stated that he was going to accpect the offer, but wanted to save on ebay fees, and stated will it be possibile if i paid in to his paypal account, i have asked many of my customers on ebay do to the same, so i thought i'll do it, cut the story short, after 20 days i didnt recevied the jacket, i made a paypal complaint, and then on the last day, he had to reponse, he shipped the jacket via express shipping !! stating that he was in hoilday in china !!! i didnt trust this seller, i wasn't quite sure if he would ship the real jacket or somthing else, so i decided to refuse the shipment, the jacket was send back to sender, paypal was aware that the jacket was send back to the seller, and deicded the case in my favour, THIS WAS IN AUGUST 2009 !! they couldn't get many money from the sellers account, stating there were no funds in there account. it was been 4 months now and still no refund, i have emailed them, soo many times, and even spoken to them on the phone !! they said THERE IS NOTHING THAT THEY CAN DO, BECAUSE THIS WASN'T AN EBAY PURCHASE!! AND THAT THE SELLER HAS NO MONEY IN THERE PAYPAL ACCOUNT !!! but they have restriced the sellers account !!! i mean WTF !! they can't get my money back. I then when on to file a complaint aganst paypal, as it says on there website, did that today !! , just got there reply today and there response was. " Thank you for contacting PayPal in relation to your query regarding a
dispute that you have filed through your account with case id
PP-719-745-198.

I have reviewed your account and it shows that the

PayPal Buyer Complaint Policy was not eligible on this claim. We conducted
an investigation but we were unable to recover all of the funds.

sellers account, meaning that we cannot reimburse you. If this transaction
occurred on an auction site, we encourage you to contact that auction site,
as they may offer a buyer protection scheme.

HOW is this FAIR !! I SWEAR PAYPAL ARE PART OF The FSA ! Which means they are reconised as a "FSA-regulated electronic money institution" , SO i should consider going to the Financial Ombudsman Service? shouldnt I? ANYONE BEEN THERE BEFORE?

i had problems before with ebay. i sold a jacket on ebay and months later the buyer filed a dispute on not recieved item which i sent it by recorded and confirmed it arrived and at the time i don't have the tracking number anymore because it was sent and it was months ago. So in the end i lost my jacket and had to cough up the refund how fair is that. Also recently i bought a hoody on ebay and it was fake so i filed item not as described and i couldn't win the case i ended up throwing it away.

Sorry to hear you have ended up in this situation Gush, really is a ball ache for sure. If you do a transaction via Paypal outside of E bay then there is very little you can do, I assume you effectively "Gifted" the money to the seller so he wouldnt loose the percentage charged for the transaction fee ( about 4% I think). Sadly this is quite a common scam, worse still is you dont even know if the jacket you would have received would have been genuine.
Naturally this advise will be next to useless but for the extra E bay charges the seller would have incurred I'd have been inclined to just send him the difference, ( ie 4% of the value of the goods so he doesnt loose out, I mean it wouldn't have added a great deal to the overall cost of £275, about an extra £11 but worth it for the transaction to remain inside of E bay).
In all honesty I would have been inclined to state that the transaction costs are his problem, if a seller lists an item then they have to take that into account not pass it on to their buyers.

Ive been very lucky with the few items Ive purchased off E Bay and only once received fake goods which I got a full refund for and kept the goods too which didnt please the owner, but tough for him LOL
But yeah like I said in another thread about E bay, its not just sellers who are crooked, buyers are just as bad, all of them creating fake high feedback scores by buying 200 sets of penny beads or something to give em a high feedback score. LOL
